Chapter I General Provisions
Article 1 In order to protect the right to information of electric power investors, operators, users and the public, and to regulate the disclosure of information on electric power supervision, these measures are formulated in accordance with the Electricity Regulatory Regulations and relevant state regulations.
Article 2 The term “electricity supervision information†as used in these Measures refers to the documents, data and charts produced, obtained or owned by the State Electricity Regulatory Commission and its dispatched institutions (hereinafter referred to as electric power regulatory agencies) in the course of fulfilling their power supervision duties.
Article 3 The State Electricity Regulatory Commission is responsible for the disclosure of national power regulatory information. The dispatched agency of the State Electricity Regulatory Commission is responsible for the disclosure of power regulatory information within its jurisdiction.
Article 4 The disclosure of power supervision information shall follow the principles of lawfulness, timeliness, truthfulness and convenience.
Article 5 No citizen, legal person or other organization may illegally obstruct or restrict the activities of information disclosure of electricity supervision.
Chapter 2 Public Content
Article 6 The power regulatory agency shall disclose the following power regulatory information:
(1) The setup, functions and contact methods of the power regulatory agency;
(2) Relevant laws, administrative regulations, rules and other regulatory documents for power supervision;
(3) The basis, procedures, conditions, time limits and requirements for various business of power supervision;
(4) The situation in which the electric power regulatory agency performs its duties of electric power supervision according to law;
(5) Other power supervision information that should be disclosed.
Article 7 In the process of formulating rules, rules or other normative documents, the electric power regulatory agency shall, in the course of formulating major interests of citizens, legal persons or other organizations, or have major social influences, disclose the draft to the public and fully listen to opinions.
Article 8 Citizens, legal persons or other organizations may propose to the electric power regulatory agency to disclose information on electric power supervision.
Where the power regulatory agency determines that the publicly recommended regulatory information of citizens, legal persons or other organizations meets the conditions for disclosure, it shall disclose it.
Article 9 In addition to the power supervision information that the power regulatory agency discloses to the public, citizens, legal persons or other organizations may apply to the power regulatory agency to provide them with relevant power supervision information.
Article 10 Where the power supervision information involves state secrets, trade secrets or personal privacy, it shall not be disclosed; except as otherwise provided by laws and administrative regulations.
Article 11 The power regulatory agency shall guarantee the authenticity and timeliness of the disclosed information and facilitate the acquisition of citizens, legal persons or other organizations.
Chapter III Forms and Procedures for Disclosure
Article 12 The electric power regulatory agency may disclose the power supervision information in the following ways:
(1) The National Electricity Regulatory Commission portal website and its sub-sites;
(2) Newspapers, radio, television and other media;
(iii) Press conference;
(iv) Compilation of policy and regulatory documents;
(5) Other ways to obtain information easily.
Major power regulatory information should be released to the public in a timely manner through a spokesperson.
Article 13 The power regulatory agency shall disclose the power supervision information in accordance with the prescribed procedures.
Article 14: Citizens, legal persons or other organizations that apply to the electric power regulatory agency for providing information on electric power supervision in accordance with the provisions of Article 9 of these Measures may submit such letters, faxes or e-mails.
For applications requiring the provision of electricity regulatory information, the power regulatory agency shall respond in accordance with the regulations. If you can reply on the spot, you should reply on the spot; if you cannot reply on the spot, you should reply within 10 days from the date of receiving the application. If the answer does not provide relevant information, the reason shall be given.
Chapter IV Supervision and Management
Article 15 The State Electricity Regulatory Commission shall supervise and inspect the situation in which the dispatched institution implements the disclosure of power supervision information.
The power regulatory agency establishes an internal management system for the disclosure of power regulatory information, and clarifies the working procedures, division of responsibilities and responsibilities of the disclosure of power regulatory information.
Article 16 If a power regulatory agency violates these Measures and has one of the following circumstances, it shall give criticism and education to the directly responsible person in charge and other directly responsible personnel; if the circumstances are serious and cause serious consequences, administrative sanctions shall be imposed according to law; Criminal prosecution according to law:
(1) Undisclosed information on power regulation;
(2) The public power supervision information is incomplete and untrue;
(3) failing to update the publicly available information on power regulation in a timely manner;
(4) divulging state secrets, trade secrets, and personal privacy;
(5) Disclosing the relevant information without authorization;
(6) Violation of the prescribed fees.
Article 17: Citizens, legal persons or other organizations that believe that the power regulatory agency has not fulfilled its obligation to disclose information on power regulatory information may report it to the relevant department.
Chapter V Supplementary Provisions
Article 18 The State Electricity Regulatory Commission of the State Electricity Regulatory Commission may formulate implementation measures in accordance with these Measures and report them to the State Electricity Regulatory Commission for approval.
